Terms of Service (Asyanna)

These Terms of Service (“Terms”) govern your use of www.asyanna.com (the “Site”) and the services provided by ASYANNA LIMITED, trading as Asyanna (“we”, “us”, “our”), including the sale of products through our online store, customer support, and related services (collectively, the “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms.

1. General Terms

These Terms constitute a legally binding agreement between you and us. If you do not agree with any part of these Terms, you must not use the Site or Services.

We may update these Terms from time to time. Changes become effective when posted on the Site, and the “Last updated” date will be revised accordingly. Your continued use of the Site after changes are posted means you accept the updated Terms.

To use our Services, you must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a legally binding contract. By using the Site, you confirm that you meet these requirements.

You agree to use the Site and Services in accordance with applicable laws and regulations. You agree not to:

4. Orders and Payment

4.1 Placing an Order

By placing an order, you are making an offer to purchase products under these Terms. Your order is accepted and a contract is formed only when we send you an order confirmation email (or otherwise confirm acceptance in writing). We may refuse or cancel an order at our discretion, for example due to suspected fraud, stock availability, pricing errors, or payment issues.

4.2 Pricing, Currency, Taxes

Prices are displayed in the currency shown at checkout. Shipping fees and any applicable taxes are shown at checkout before you complete payment.

Import duties and local taxes: If your order is shipped internationally, import duties, customs fees, or local taxes may apply depending on your location and local regulations, unless stated otherwise at checkout. Where applicable, such charges may be collected by the carrier or local authorities.

4.3 Payment Methods

We accept payment methods shown at checkout (which may include credit/debit cards, PayPal, and other options). Payments are processed by third-party payment providers. You agree to provide accurate payment information and authorize us (and our payment providers) to charge the total order amount.

5. Shipping and Delivery

Estimated delivery times and shipping fees are provided on our Shipping Policy page and/or at checkout. Delivery times are estimates and may vary due to factors outside our control, including shipping carrier delays, customs processing, peak periods, or force majeure events.

Risk of loss passes to you upon delivery to the address you provided, except where mandatory consumer laws provide otherwise.

6. Returns and Refunds

Our returns and refunds are governed by our Returns & Refund Policy, which forms part of these Terms.

6.1 EU/EEA Consumers — 14-Day Right of Withdrawal

If you are a consumer in the EU/EEA, you generally have the right to withdraw from your purchase within 14 days of receiving the goods, without giving any reason, subject to legal exceptions (such as certain sealed hygiene goods if unsealed after delivery).

To exercise the right of withdrawal, contact us at info@asyanna.com with your order number and a clear statement of your decision to withdraw. You must return the goods within 14 days from the day you notify us.

If the withdrawal is valid, we will refund you in accordance with applicable law (including, where required, the cost of standard outbound delivery), using the same payment method you used for the purchase, within the legally required timeframe.

6.2 Store Return Policy

In addition to any rights you may have under mandatory consumer law, we offer a store return policy as described in our Returns & Refund Policy (including eligibility, excluded items, and refund timelines).

7. Product Descriptions and Availability

We aim to ensure product descriptions and availability are accurate, but errors may occur. If we discover an error relating to your order (including pricing or availability), we may correct it and notify you before completing the order, or cancel the order and refund you if necessary.

Product images are for illustrative purposes only; actual product appearance or packaging may vary.

8. Intellectual Property

All content on the Site (including text, images, logos, graphics, videos, and software) is owned by or licensed to us and is protected by applicable intellectual property laws. You may not use, reproduce, modify, distribute, or exploit any Site content without our prior written permission, except as permitted by law.

9. Limitation of Liability

To the fullest extent permitted by law:

  • The Site and Services are provided on an “as is” and “as available” basis.

  • We are not liable for indirect, incidental, special, consequential, or punitive damages (including loss of profits, revenue, or data) arising from your use of the Site or Services.

  • Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including mandatory consumer rights.

10. Privacy and Data Protection

We process personal information in accordance with our Privacy Policy, which explains what data we collect, how we use it, and your rights (including rights under the EU GDPR where applicable).

11. Consumer Rights

Nothing in these Terms affects your rights under mandatory consumer protection laws that apply to you. If you are a consumer in the EU/EEA, you may have additional statutory rights, including rights relating to faulty or non-conforming goods under applicable EU consumer laws.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Hong Kong SAR.

Any disputes arising out of or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the courts of Hong Kong SAR, meaning we may also bring claims in another jurisdiction if permitted by applicable law.

If you are a consumer in the EU/EEA, mandatory consumer laws in your country of residence may also apply and may give you additional rights.
